Terms & Conditions

This document sets out the terms of participation in "The Good Game Game" (the "Competition").

  1. The promoters of the Competition are the Australian Broadcasting Corporation ("the ABC") (ABN 524 292 78345), 700 Harris Street, Ultimo, 2007, New South Wales, Australia, and the Australian Film Commission (the "AFC") of 150 William Street, Woolloomooloo, 2011, New South Wales, Australia, a statutory corporation established by the Australian Film Commission Act 1975 (Cth).
  2. Entry to the Competition is open to Australian citizens and permanent residents of Australia. An entrant must be an individual and not a company or organisation. Entrants under 18 years of age need to have the consent of their parent or guardian to enter. Employees of the ABC or any person associated with the Competition, or any organisation or individual associated with the provision of the prize(s) are not eligible to enter.
  3. Each entry must be entered in accordance with these Terms and Conditions. By entering the Competition, each entrant agrees to be bound by these Terms and Conditions. The ABC and the AFC may in their discretion refuse to award any prize to any entrant who fails to comply with these Terms and Conditions. All relevant instructions on the ABC's website (www.abc.net.au/tv/goodgame) ("the Website") form part of these Terms and Conditions.
  4. Entry into the Competition is free.
  5. The Competition opens on 3 March 2008. Entries for Stage 1 close on 31st of March 2008 @ 5pm. Entries for Stage 2 close at 5 p.m. AEST on 2 June 2008 ("Competition Period"). Any entry received for any Stage after the expiry of the Competition Period for that Stage will be deemed invalid. No responsibility is accepted for late, lost, delayed or misdirected entries.
  6. To enter the Competition, you must:
    1. register your details with ABC Communities on the Website;
    2. complete the entry form available on the Website ("Entry Form");
    3. produce material as outlined on the Website (the "Material"), and submit the Material and the Entry Form either;
      1. by uploading both to the Website; or
      2. by providing the Material in disk or written format, along with a printed, completed copy of the Entry Form either by direct mail to The Good Game "Game", c/- Australian Broadcasting Corporation, PO Box 4112, Ultimo, NSW 2007, or in person marked to the attention of The Good Game "Game" at the ABC's Sydney offices at 700 Harris Street, Ultimo.
  7. By submitting the Material to the ABC, you assign to the ABC and its licensees and assignees all rights (including copyright) in perpetuity throughout the world in the Material and all other material provided by you to the ABC pursuant to this Competition Entry to the Competition is deemed to be an entry in writing, signed by or on behalf of the owner of copyright for the purposes of the Copyright Act 1968 (Cth).
  8. If you are not chosen as either a Stage Winner or a Key Contributor (as defined below), then the ABC shall promptly reassign all rights in the Material you have provided pursuant to this Competition back to you, effective immediately upon the announcement of the final Stage Winners and Key Contributors, as published on the Website on 17 June 2008. Notwithstanding the above, the ABC shall retain the non-exclusive, non-commercial right in perpetuity and throughout the World to reproduce and communicate your Material for the purposes of promoting the Competition and Good Game.
  9. The Material may be edited or adapted at any time by the ABC in order to:
    1. develop, produce and exploit a playable game prototype ("the Prototype");
    2. meet the requirements of broadcasting authorities;
    3. adhere to any requirements of the ABC Editorial Policies (available at www.abc.net.au/corp );
    4. ensure the Material meets any legal or classification requirements or to avoid any breach of law;
    5. use the Material for promotional purposes; and/or
    6. use the Material on other ABC media platforms.
  10. You further acknowledge that the ABC may allow users to view, listen to, reproduce, download, edit, adapt, and otherwise deal in the copyrights attached to and embodied in the Material. The ABC aims to ensure that any use of the Material not authorised by the ABC will not occur, however you acknowledge that the ABC is not equipped with mechanisms to prevent unauthorised use of the Material, and you accept that, to the extent allowable under the law, the ABC has no liability to you for how the end user elects to use the Material, and as such it may be permanently stored, reproduced, copied, distributed or the like, without recourse or remedy against the ABC.
  11. The Material provided will be subject to a pre-selection process, and then judged by the ABC's and AFC's panel of judges. The Material judged to be the best, most original and creative for each of the two (2) Competition Stages will win the major prize for that stage ("Major Prize"), and the relevant entrants will be declared the "Stage Winners".
  12. Each Major Prize shall comprise:
    1. one (1) internship with a games development company, including associated wages, travel and on-costs to the value of AUD$10,000; and
    2. a credit for the Stage Winners on the Website, and on the Prototype where it is made available as a download from the Website.

    In the event that the Prototype is successfully sold to a games publishing and/or distribution company, then the ABC and AFC will also seek (but not guarantee) both a credit for the Stage Winners in the commercial release of the game, and a percentage of net profits, with any resulting royalty to be negotiated and divided amongst the ABC, the games publishing an/or development company, and the Stage Winners in accordance with standard industry practice.

    Other prizes (multiple or otherwise) may also be awarded to entrants ("Key Contributors") at the ABC's and AFC's discretion, with such prizes comprising the following:

    1. one (1) Microsoft Xbox 360;
    2. one (1) Sony PlayStation 3;
    3. one (1) Nintendo Wii;
    4. two (2) Nintendo DS;
    5. two (2) Sony PSPs (PlayStation Portable); and
    6. ten (10) Good Game t-shirts.

    Key Contributors will receive a credit on the Website, and on the Prototype where it is made available as a download from the Website. Other entrants may also be provided a credit on the Website at the discretion of the ABC and AFC.

  13. Chance plays no part in determining the prize winners.
  14. All entries become the property of the ABC and will not be returned to the entrants.
  15. You warrant that:
    1. all details provided with your entry are true and accurate;
    2. you have all necessary rights and licences to grant the rights set out in these Terms and Conditions;
    3. the Material is an original work and has not been previously communicated to the public;
    4. you are the copyright owner or authorised licensor of all copyright works and subject matter comprising the Material (including the film, sound recording, musical and literary works);
    5. the Material does not contain any commercial sound recordings;
    6. composed music included in the Material is fully cleared and has not been provided by anyone that is either published, or is currently a member of the Australasian Performing Rights Association ("APRA");
    7. the exercise of the rights granted to the ABC in these Terms and Conditions will not infringe the rights of any third parties; and you will indemnify the ABC against any loss or damage resulting from any breach of these warranties.
  16. You acknowledge that the ABC and AFC are under no obligation to exercise any of the rights granted to it by these Terms and Conditions, and providing downloads and any communicating of the Material to the public by the ABC is at the complete discretion of the ABC.
  17. You agree that the ABC may use your entry and any personal details provided to the ABC for any promotional, marketing and publicity purposes of the ABC in any media without notice and without any fee being paid to you.
  18. Decisions of the ABC and AFC and its panel of judges are final and will be binding on each person who enters the Competition and no correspondence will be entered into. The names of the Stage Winners and the city/town/suburb in which they live will be announced on 21 April 2008 (Stage 1) and 16 June 2008 (Stage 2), and posted on the Website. Each Winner will be notified using the contact details provided in the Entry Form.
  19. If there is any event that prevents or hinders the ABC's conduct of the Competition or the ABC's ability to deliver prize/s to the winners of the Competition, the ABC may, in its discretion, cancel the Competition and recommence it at another time under the same conditions or select another winner.
  20. The ABC is not responsible for any incorrect or inaccurate information, or for any of the equipment or programming associated with or utilised in this Competition, or for any technical error that may occur in the course of the administration of this Competition. The ABC assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorised access to or alteration of entries.
  21. Each party must do, sign and execute all deeds, schedules, acts, documents and things as may reasonably be required by the other party so as to carry out and give effect to the terms and intentions of these Terms and Conditions effectively and to perfect, protect and preserve the rights of the parties hereunder whether before or after completion.
  22. To the full extent permitted by the law, neither the ABC nor the AFC will be liable for any injury, damages, expenses, or loss whatsoever (whether direct or inconsequential) to persons or property as a result of any person entering into the Competition or accepting or using any prize, including without limitation non-receipt of any prize or damage to any prize in transit.
